This is an English translation provided for convenience. The French version is the legally binding one and prevails in case of discrepancy.
Draft version: details in yellow will be filled in before the shop opens.
1. Who is selling?
Sales on browsterz.com are made by Lionel Braun, sole trader (French "entrepreneur individuel", micro-entreprise), trading as BROWSTERZ, SIRET TO BE COMPLETED: SIRET, address TO BE COMPLETED: address, email crew@browsterz.com, phone TO BE COMPLETED: phone (hereinafter "BROWSTERZ").
These terms of sale apply to every order placed on the site by a consumer. You accept them by ticking the box provided when you order. The applicable version is the one online on the day of your order.
2. Products
BROWSTERZ sells limited-edition prints of the crew's artworks: high-quality prints, hand-signed and numbered, in a number of copies stated on the product page. A sold-out edition is never reprinted. Original artworks are not sold on the site.
The main features (size, paper, number of copies) are stated on each product page. Photos are as accurate as possible, but colours depend on your screen. Signatures and numbering are done by hand, so they vary slightly from one print to another.
Custom commissions (artwork made on request) are quoted separately by email.
3. Prices
Prices are in euros, all taxes included. VAT not applicable, article 293 B of the French Tax Code. Shipping costs are shown before you confirm your order (see Shipping & returns). For deliveries outside the European Union, customs duties or import taxes may be charged on receipt: they are paid by the buyer.
BROWSTERZ may change its prices at any time. You pay the price shown when you place your order.
4. Promo codes
A promo code can be used under the conditions announced with it (amount, validity period, eligible products). Unless stated otherwise: one code per order, not combinable, not exchangeable for cash, and only valid during its validity period.
5. Ordering
- Add products to your cart, then go to checkout.
- Enter your details and delivery address, and pick a shipping method.
- Check the summary (products, prices, shipping costs) and correct any mistakes.
- Accept these terms, then click the order button, which means you commit to pay.
- Once payment is accepted, you receive a confirmation email: the sale is then complete.
Editions being limited, an order is only confirmed if a copy is still available at the time of payment. If a product can't be delivered after all, we let you know by email and refund you within 14 days at most.
BROWSTERZ may refuse an order in case of an existing dispute with the buyer or suspected fraud.
6. Payment
Payment is by card (Visa, Mastercard, American Express) or the other methods offered at checkout, through Stripe, a secure payment provider. BROWSTERZ never sees your card details. You are charged when you place the order.
Products remain the property of BROWSTERZ until the price is paid in full.
7. Delivery
Products are delivered to the address given when ordering, within the stated time (see Shipping & returns). If no time is stated, delivery happens no later than 30 days after the order. If delivery is late, you can ask us to deliver within a reasonable extra period, then, if it still doesn't arrive, cancel the order and get a refund (articles L. 216-1 to L. 216-7 of the French Consumer Code).
The risk of loss or damage passes to you when you (or someone you appoint) physically take possession of the parcel. If the parcel arrives damaged, note it with the carrier if you can, take photos and let us know quickly at crew@browsterz.com. This doesn't affect any of your rights.
8. Right of withdrawal (14 days)
You have 14 days from receiving the product to change your mind, without giving a reason or paying any penalty (articles L. 221-18 and following of the French Consumer Code). For an order delivered in several parcels, the period starts when you receive the last one.
To use it, send us a clear statement before the deadline (an email is enough) at crew@browsterz.com, or the model form on the Shipping & returns page.
- Send the product back no later than 14 days after telling us, in its original packaging if possible.
- Return shipping costs are paid by you.
- We refund everything you paid, including the original shipping (at the cheapest standard shipping rate offered), no later than 14 days after your request, using the same payment method. We may wait until we have received the product (or proof that you sent it) before refunding.
- You may be liable if the product is damaged by handling beyond what is needed to inspect it (for example: a print that has been framed, cut, folded, glued or written on).
Exception: the right of withdrawal doesn't apply to artworks made to order following your specifications (custom commissions), under article L. 221-28 of the French Consumer Code.
9. Legal guarantees
All products are covered by the legal guarantee of conformity and the guarantee against hidden defects. No additional commercial guarantee is offered. Below is an English translation of the mandatory French text (the official French wording prevails).
The consumer has two years from delivery of the goods to obtain the application of the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only has to prove the existence of the lack of conformity, not the date it appeared.
Where the contract of sale provides for the continuous supply of digital content or a digital service for more than two years, the legal guarantee applies to that digital content or service throughout the planned supply period. During this period, the consumer only has to prove the existence of the lack of conformity affecting the digital content or service, not the date it appeared.
The legal guarantee of conformity requires the professional, where applicable, to provide all updates needed to keep the goods in conformity.
The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of the request, free of charge and without major inconvenience.
If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.
If the consumer asks for a repair but the seller imposes a replacement, the legal guarantee of conformity is renewed for two years from the date of replacement.
The consumer may obtain a price reduction while keeping the goods, or terminate the contract and be fully refunded in exchange for returning the goods, if:
1° The professional refuses to repair or replace the goods;
2° The repair or replacement takes place after thirty days;
3° The repair or replacement causes major inconvenience to the consumer, in particular where the consumer permanently bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods;
4° The lack of conformity persists despite the seller's unsuccessful attempt to remedy it.
The consumer is also entitled to a price reduction or to terminate the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer then doesn't have to ask for a repair or replacement first.
The consumer is not entitled to terminate the sale if the lack of conformity is minor.
Any period during which the goods are unavailable for repair or replacement suspends the remaining guarantee period until the goods are returned in working order.
The rights above result from articles L. 217-1 to L. 217-32 of the French Consumer Code.
A seller who obstructs the application of the legal guarantee of conformity in bad faith is liable to a civil fine of up to €300,000, which may be raised to 10% of average annual turnover (article L. 241-5 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund in exchange for returning them.
If the edition is sold out, replacement may be impossible: the guarantee then takes the form of a price reduction or a refund. To use it, email us at crew@browsterz.com with your order number and photos.

12. Record keeping
For any order of €120 or more, BROWSTERZ keeps the contract for 10 years from delivery and gives you access to it on request (articles L. 213-1 and D. 213-1 of the French Consumer Code). Your orders are also available in your customer account.
13. Complaints and mediation

14. Governing law
These terms are governed by French law. In case of dispute, and failing an amicable agreement, French courts have jurisdiction. If you live in another EU country, you keep the protection of the mandatory rules of your country of residence and may bring a case before the courts where you live.
